 J. D. Obenberger

Joe Obenberger in Red Suspenders croppedStarting from the representation of brick and mortar adult book stores, gentlemen's clubs and other Adult businesses in the Chicago area in 1994, JD Obenberger has developed an outstanding national and international reputation for representing the interests of the online entertainment community, the Chicago Adult Entertainment community, and he is an advocate of Liberty in general. He has worked to the advantage of his clients at every step of government attack, from aggressive and vigorous intervention during the execution of a federal search warrant through its final successful outcome and in other cases from charges to trial; He successfully litigated the Mike Jones criminal obscenity case obtaining a dismissal on all charges, and has achieved favorable results in other obscenity prosecutions and federal law enforcement raids based on obscenity. XXXLAW has represented numerous clients in North America, Europe, and the Pacific Rim, providing services in all of the legal issues confronting the webmaster and content producer: The defense of content producers and retailers accused of obscenity, copyright infringement and right to privacy representation, domain name disputes, and content reviews of adult megasites are regular parts of its practice area. Obenberger is a popular worldwide speaker on issues of adult internet law and regulation, having spoken 72 times since 2000 before thousands of adult webmasters and content producers in the United States, Canada, Germany, Hungary, Holland, and Costa Rica, in ten American states and in three Canadian provinces. He is the author of "Pleasureboating on the River Rubicon", published in hardcover during 2007 by the Thompson-West Publishing Company in its anthology, Online Pornography. He has written frequently, for over a decade, for AVN Online, XBIZ World, Klixxx, Adult Store Buyer and other adult Industry periodicals and trade sites. He is deeply committed to personal liberty and privacy from the interference of government in the spirit of the American Constitution, and in the American political tradition. His personal heroes include Barry Goldwater.

He is a former Army Officer, was elected Municipal Alderman twice and Mayor Pro Tem once, elected Republican Committeeman three times in two states, and taught college. A long and interesting journey took him to the representation of adult interests - and all of it uniquely prepared him for this role.

J. D. Obenberger is a graduate of the University of Wisconsin Law School (J.D., 1979), the United States Army Judge Advocate General's School (1979), and the National Institute of Trial Advocacy (1986).

He was decorated for distinction as a criminal defense lawyer while a Captain of the US Army Judge Advocate General's Corps and was undefeated when he brought cases on behalf of the United States as a prosecutor. While a Captain in the Army JAG Corps, he lived in Germany for three years, and speaks fair conversational German. He has taught trial tactics to the attorneys of the United States Army Trial Defense Service. He taught Political Science for Central Texas College (1982). He often provides commentary in television and print media on issues affecting online communications and has been quoted by the Wall Street Journal, the Boston Globe, Wired, AVN Online, XBIZ, YNOT News, Klixxx and numerous other publications, and has been a guest on The O'Reilly Factor. He is a frequently-contributing "expert" in the field of Adult Film Making at allexperts.com.

 He is an active member of The First Amendment Lawyer's Association and the Free Speech Coalition. He has handled a wide variety of criminal cases, ranging from obscenity to conspiracy, aggravated kidnapping, forgery and drug cases, both as a prosecutor and as defense counsel, at trial and on appeal, and in locations as geographically diverse as Brownsville, Texas, Vicenza, Italy, and throughout Germany. He is admitted to practice before the United States Supreme Court, the United States Courts of Appeal for the Federal Circuit and the Seventh Cirucuit, the United States District Courts for the Eastern and Western Districts of Wisconsin, the Northern District of Illinois (admitted to its Trial Bar), The United States Court of Military Appeals, and the Supreme Court of Illinois.

Reed Lee

Reed Clayton Lee has been practicing law for more than twenty-five years and concentrating on free expression matters for well over fifteen years.

His free expression work has involved representation of clients ranging from political activists of widely varying points of view to those who produce and disseminate sexually oriented expression. Reed has written Amicus Briefs at the Supreme Court of the United States and has argued numerous appeals both in the appeals courts of the State of Illinois and the federal courts, including the United States Seventh Circuit Court of Appeals. 

He has represented clients in both civil and criminal matters, and - in the civil cases - he has represented those seeking affirmative relief against threatened government action as well as those defending against proceedings the government has brought. In all free expression and related cases, though, he has represented the free speech claimants, that is, those who faced trouble with some government agency because of what they had to say or publish or what they wanted to read, see, or hear.

He has acted as defense counsel in criminal obscenity jury trials, with the late Michael Null, involving both live performances and videotapes. Along with J. D. Obenberger, he has defended obscenity cases in both Illinois and Louisana that successfully terminated before trial.

He attended law school at Case Western Reserve University in Cleveland, Ohio and did his undergraduate work at the University of Illinois at Chicago.

Mr. Lee is an active member of the First Amendment Lawyers' Association and the Constitutional Law Committee of the Chicago Bar Association. He is a former President of the First Amendment Lawyers' Association and a member of its Board and he is a member of the Board of Directors of the Free Speech Coalition, the adult industry's trade organization, and its Litigation Committee.

In connection with the defense of free expression, he has defended clients against condemnation of real property by government authority and has handled for them a wide array of commercial and corporate matters in litigation. Fighting City Hall - and getting good results - has been part of Reed's life for decades. He successfully brought a civil rights action against the County of DuPage in Unied States District Court, obtained summary judgment including the award of attorney's fees, successfully argued the subsequent appeal to the Seventh Circuit, and successfully argued against Certiorari to the Supreme Court of the United States. By that successful litigation, he secured the right of our clients to open and operate the the first lawfully permitted Adult Use in DuPage County, Diamond's. It was necessary in that litigation to overcome arguments made - seriously - by the County that the Club would imperil the animals in a portion of a Forest Preserve not open to public recreation, and that its existence might adversely affect the students in school busses traveling along Illinois Highway 64 on field trips, en route to the more distant parts of the Forest Preserves actually open to recreation. Reed Lee is admitted to the bar of the United States Supreme Court, the United States Courts of Appeal for the Sixth, Seventh, and Ninth Circuits, and the United States District Courts for the Eastern District of Wisconsin, the Eastern District of Michigan, and the Northern District of Illinois.
